A Lasting Power of Attorney allows you to choose someone you trust to make important decisions on your behalf if you are unable to make them yourself. You can decide what decisions your nominated Attorney will be able to make on your behalf, ensuring your needs will be met without giving away more control than you are happy with.

It is entirely up to you who you choose to represent you as an Attorney. They need to be over 18, of full mental capacity and willing to undertake the role. You need to trust that they will act in your best interest.

A Lasting Power of Attorney (LPA) allows you to assign your loved ones the legal authority to make key decisions about your finances, health and welfare should you be unable to do so yourself.  LPAs can cover health and welfare issues such as medical care, where you live, property and financial issues (e.g. selling your home) and managing your pension.

It’s advisable that a qualified person drafts the Lasting Power of Attorney (LPA). It then needs to be registered with the Office of the Public Guardian (OPG) by either the 'Donor' (the person making the LPA) or the 'Attorney' (if it is now time to use the LPA) so that it has legal force.

There are two types of Lasting Power of Attorney (LPA):

This allows you to choose Attorneys to have authority to deal with all your financial affairs.

Health & Welfare

This allows you to choose Attorneys to make decisions about your health and welfare issues.

Lasting Power of attorney (LPA)

This offers peace of mind that people you trust will legally be allowed to manage your financial affairs on your behalf if the need arises. This can include:

  • Paying bills
  • Claiming benefits, pensions and allowances
  • Operating bank or building society accounts
  • Giving gifts to family members or charities
  • Buying or selling property

Without this type of LPA, your loved ones may find it difficult to manage your financial affairs on your behalf, as they may not have the legal authority to do so.

  • Investments may go unmanaged.
  • Property may fall into disrepair.
  • Your family may have to apply to the Court of Protection to manage your affairs, which can be a more expensive and time-consuming process than having an LPA in place.
Health & Welfare
Lasting Power of attorney (LPA)

This allows your Attorneys to make decisions on your behalf about your personal welfare, such as:

  • Giving or refusing consent to medical treatment
  • Deciding where you live

 A Health & Welfare LPA only takes effect if you lose mental capacity.
